2. Agreement to these terms
By using the Site or placing an order with us, you agree to be bound by these Terms of Service, our Privacy Policy, our Refund & Returns Policy, and our Shipping Policy. If you do not agree to these terms, please do not use the Site.
We may update these terms from time to time. The version in force is the one published on the Site at the time you place an order. We'll flag material changes where we reasonably can.
3. Using our Site
You must be at least 18 years old, or using the Site under the supervision of a parent or guardian, to place an order.
You agree to use the Site only for lawful purposes and not to:
-
● Use the Site in any way that breaches applicable law or regulation
-
● Attempt to gain unauthorised access to the Site, our systems, or other users'
accounts
-
● Use any automated system (bots, scrapers, etc.) to access the Site without our
permission
-
● Post or transmit anything unlawful, harmful, or infringing of others' rights
We may suspend or terminate your access to the Site if we reasonably believe you have breached these terms.
4. Products 4.1 Descriptions
We make every effort to describe and display our plants and products accurately, including size, condition, and appearance. However:
-
● Plants are natural products and will vary in size, shape, colour, and maturity from the images shown — this is normal and not a fault
-
● Colours may also vary slightly due to screen settings and photography
4.2 Availability
All products are subject to availability. Where an item becomes unavailable after you've ordered it (including due to seasonal or growing conditions affecting plant stock), we will contact you to offer a substitute, refund, or delay, as set out in our Refund & Returns Policy.
4.3 Pricing
-
● All prices are shown in GBP (£) and are inclusive of VAT where applicable
-
● Delivery charges are shown separately at checkout and are also set out in our
Shipping Policy
-
● We take reasonable care to ensure prices are correct, but errors can occasionally occur. If we discover a pricing error on your order, we'll contact you before proceeding, and you'll be free to cancel
5. Orders and contract formation
-
● Placing an order through the Site is an offer by you to buy the products in your order
-
● We will send an order confirmation email, but this does not mean we have accepted
your order — a contract is only formed when we send you a dispatch confirmation
(or, for made-to-order/collection items, when we confirm we can fulfil the order)
-
● We may decline or cancel an order at our discretion (for example, in cases of
suspected fraud, pricing errors, or stock unavailability), in which case we will notify you and refund any payment taken
6. Payment
We accept the payment methods shown at checkout, which may include credit and debit cards, PayPal, Klarna, Shop Pay, Apple Pay and Google Pay. Payment is taken at the point of order via our payment processor. We do not store your full payment card details — see our Privacy Policy for details of how payment data is handled.
8. Your statutory rights (Consumer Rights Act 2015)
Nothing in these terms affects your statutory rights as a consumer. Under the Consumer Rights Act 2015, goods we supply to you must be:
-
● Of satisfactory quality
-
● Fit for purpose
-
● As described
If a product doesn't meet these standards, you may be entitled to a repair, replacement, price reduction, or refund, depending on how long you've had the item and the circumstances. See our Refund & Returns Policy for how to raise this with us. Nothing in these terms limits or excludes these statutory rights.
9. Delivery
Delivery timescales, costs, and methods are set out in our Shipping Policy. Risk in the products passes to you once they've been delivered to the address you provided; ownership passes once we've received payment in full.
10. Our liability
-
● We are responsible for foreseeable loss and damage caused by us. We are not responsible for any loss or damage that is not foreseeable, or that results from your breach of these terms
-
● Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot lawfully be limited or excluded under English law
-
● We are not liable for losses caused by matters outside our reasonable control (for example, extreme weather delaying delivery of plants), except as set out in our Shipping Policy
-
● Advice given on the Site or by our staff about planting, growing conditions, or care is offered in good faith based on general horticultural knowledge, but growing success depends on many factors outside our control (soil, climate, aftercare), and we can't guarantee specific growing outcomes
11. Intellectual property
All content on the Site — including text, images, logos, plant photography, and design — is owned by us or our licensors and is protected by copyright and other intellectual property laws. You may not copy, reproduce, or use our content for commercial purposes without our written permission.
12. Third-party links and services
The Site may contain links to third-party websites or use third-party services (such as payment providers and couriers). We are not responsible for the content, policies, or practices of third-party sites. Please review their own terms and privacy policies.
13. Reviews and user content
If you leave a review or other content on the Site or via a third-party review platform (e.g. TrustPilot), you confirm it is honest, accurate, and does not infringe anyone's rights. We reserve the right to remove content we reasonably believe is false, abusive, or unlawful.
14. Governing law and disputes
These terms are governed by the laws of England and Wales. If you are a consumer, you can bring proceedings in relation to these terms in the courts of the country in the UK in
which you live. We will also try to resolve any dispute with you informally in the first instance — please contact us at info@leahurstnurseries.com.
